Terms of Service: Rec Soccer

Important Notice

Rec Soccer is currently in active development (beta). Features and functionality may change without notice.
Rec Soccer is operated by Attuned Ventures LLC as a third-party software platform provider.
Attuned Ventures LLC is NOT a party to any agreements, arrangements, or disputes between players, teams, team captains, facilities, leagues, or event organizers.
We do not own, operate, or control any sports facilities, leagues, teams, or events.
Any interactions, payments, injuries, disputes, or issues between users, teams, facilities, or other third parties are solely between those parties.
Use of this app is at your own risk.

1. Welcome to Rec Soccer

By creating an account, you agree to these Terms of Service.
Rec Soccer is operated by Attuned Ventures LLC.
This app is currently in beta—features may change.
If you do not agree to these terms, please do not use the app.

2. Eligibility

You must be at least 18 years old to create an account, OR have the consent of a parent or guardian who agrees to these terms on your behalf.
Users between 13 and 17 years old may only use the app under the supervision and with consent of a parent or legal guardian.
Rec Soccer is not intended for children under 13. We do not knowingly collect information from children under 13.
Team organizers are responsible for ensuring that teams with minor participants have appropriate adult oversight.
By creating a team that includes minors, you represent that you have appropriate authority to include those players and have obtained any necessary parental consent.

3. Account Creation & Responsibility

Provide accurate, current, and complete information when creating your account.
You are responsible for maintaining the confidentiality of your login credentials.
You are responsible for all activity that occurs under your account.
Notify us immediately at security@recsoccer.app if you suspect unauthorized access.
Do not share your account with others or allow others to access your account.
Keep your account information updated, including email and phone number.

4. Team Organizer Responsibility

Team captains and organizers are responsible for managing their team's roster, schedule, and payments.
Organizers must ensure all team members agree to these Terms of Service.
Organizers are responsible for verifying the eligibility of players they add to their roster.
Organizers who collect payments through the app are responsible for distributing funds appropriately.
Teams with minor players must have a responsible adult as the team organizer.
Organizers must handle disputes between team members fairly and in accordance with these terms.
Rec Soccer is not liable for disputes between team members, organizers, or facilities.

5. What You Can Do

Create, join, and manage games, leagues, and events.
Build rosters, send invitations, and request subs.
Communicate with teammates via in-app chat.
Receive notifications via push, email, or SMS.
Collect and track team payments.

6. Payments & Fees

Payment Processors: Payments are processed through Stripe, Apple App Store, and Google Play Store. Each processor has its own terms and privacy policy.
In-App Purchases: Some features require in-app purchases (e.g., Rec Coins). Prices are displayed before purchase and include applicable taxes.
Team Payment Tracking: Rec Soccer provides tools to track team payments. We do not process or hold team-to-team payments—those are made directly between users via their preferred payment apps (Venmo, Cash App, Zelle, PayPal, etc.).
App Store Fees: Purchases made through the Apple App Store or Google Play Store are subject to their respective fees (typically 15-30%).
Stripe Fees: Payments processed through Stripe may incur standard processing fees as disclosed at the time of transaction.
No Hidden Fees: All fees are disclosed before you complete a transaction.
Taxes: You are responsible for any applicable taxes on purchases.

7. Refund & Cancellation Policy

In-App Purchases: Refunds for in-app purchases (including Rec Coins) follow Apple App Store or Google Play Store refund policies. Contact the respective store for refund requests.
Subscriptions: You may cancel the premium subscription at any time in the app's Settings > Premium. Cancellation takes effect at the end of the current billing period.
Team Payments: Refunds for team payments made outside the app (via Venmo, Cash App, etc.) are handled directly between the payer and payee. Rec Soccer is not responsible for these refunds.
No Refunds for Used Services: We generally do not provide refunds for services that have already been rendered or digital goods that have been consumed.
Discretionary Refunds: We may, at our sole discretion, provide refunds or credits in cases of technical issues or extenuating circumstances.
Chargebacks: Initiating a chargeback without first contacting us may result in account suspension. Please contact support@recsoccer.app to resolve payment disputes.

8. User Conduct & Messaging Rules

Treat all users with respect—no harassment, bullying, or hate speech.
Do not impersonate others or create fake accounts.
Do not post spam, advertisements, or promotional content without permission.
Do not share inappropriate, offensive, or illegal content.
Do not use the messaging features for commercial solicitation.
Do not share personal information of others without their consent.
Report misconduct through in-app support or email support@recsoccer.app.
Violations may result in content removal, account suspension, or termination.

9. Facility Use & Assumption of Risk

Play and participation in sports involve inherent risks of injury; you are responsible for your own safety, fitness, and equipment.
Rec Soccer is a software platform and does not own, operate, or control any sports facilities; facility staff and referees are independent.
Follow venue rules, waivers, and insurance requirements set by facilities, leagues, or event organizers.
By using the app to join games or events, you acknowledge and accept these inherent risks.

10. AI-Powered Content Moderation

Chat messages may be reviewed by AI to detect harmful content such as harassment, hate speech, threats, spam, and explicit material.
We use OpenAI's moderation API to help identify and flag potentially harmful messages.
AI moderation is automated—no human reads your messages unless they are flagged for review.
Flagged content may be reviewed by our team to enforce community guidelines.
Message text is sent to OpenAI's API for moderation analysis only. OpenAI does not use your messages to train their models (per their API data usage policy).
No message content is stored by OpenAI after processing.
You can appeal any moderation action through in-app support or by emailing support@recsoccer.app.

11. Content Ownership & License

Rec Soccer, its logo, design, and proprietary content are owned by Attuned Ventures LLC.
You retain ownership of content you create (photos, messages, team information, etc.).
By posting content, you grant Rec Soccer a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute your content within the app and for promotional purposes.
You represent that you have the right to share any content you post.
We may remove content that violates these terms or applicable law.
Do not copy, modify, reverse engineer, or distribute our app without written permission.

12. Termination & Suspension Rights

Your Right to Terminate: You may delete your account at any time in Settings. Upon deletion, your data will be removed in accordance with our Privacy Policy.
Our Right to Suspend: We may suspend your account immediately if we suspect a violation of these terms, fraudulent activity, or harmful behavior.
Our Right to Terminate: We may terminate accounts that repeatedly violate these terms, engage in illegal activity, or are inactive for extended periods.
Effect of Termination: Upon termination, your right to use the app ends immediately. You lose access to any purchased content or features, except as required by applicable law.
Data After Termination: We may retain certain data as required by law or for legitimate business purposes (e.g., fraud prevention).
Appeals: If you believe your account was suspended or terminated in error, contact support@recsoccer.app.

13. Advertising

The app displays advertisements from Google AdMob (banner, interstitial, and rewarded video ads) and Klipy to support the free app experience.
Ad content is provided by third parties, not Attuned Ventures LLC.
You may see personalized ads based on your interests and activity.
Rewarded video ads are optional—you may choose to watch them in exchange for Rec Coins (in-app virtual currency). Rewarded ads are limited to 5 per day.
Interstitial ads may appear during natural app transitions and are frequency-capped to minimize disruption.
Premium subscribers ($1/month) enjoy an ad-free experience. See the Premium Subscription section below.
Adjust ad preferences in your device settings.

14. Premium Subscription

Rec Soccer offers an optional premium subscription for $1/month that removes all advertisements from the app.
Subscriptions are billed monthly via Stripe and auto-renew until cancelled.
You may cancel your subscription at any time in Settings > Premium. Cancellation takes effect at the end of the current billing period—you retain premium access until then.
No refunds are provided for partial billing periods.
Premium benefits include: ad-free experience across all screens, and a premium member badge on your profile.
We reserve the right to change subscription pricing with 30 days' notice. Existing subscribers will be notified before any price change takes effect.
If payment fails, your subscription status changes to past-due. If not resolved, premium access will be revoked when the billing period ends.

15. Third-Party Links & Services

The app may contain links to external websites or services.
We are not responsible for third-party content or practices.
Review the terms and privacy policies of any external sites you visit.
Third-party integrations (maps, payments) have their own terms.

16. Limitation of Liability

The app is provided "as is" and "as available" without warranties of any kind, express or implied.
We do not warrant that the app will be uninterrupted, error-free, or secure.
We are not liable for disputes between users, teams, facilities, or any third parties.
Soccer and other physical activities involve inherent risks—you participate at your own risk.
To the maximum extent permitted by law, Attuned Ventures LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages.
Our total liability for any claims arising from your use of the app is limited to the amount you paid us in the 12 months preceding the claim, or $100 USD, whichever is greater.
Some jurisdictions do not allow limitation of liability, so some of these limitations may not apply to you.

17. Indemnification

You agree to indemnify, defend, and hold harmless Attuned Ventures LLC, its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, or expenses arising from:
Your use or misuse of the Rec Soccer app or services.
Your violation of these Terms of Service.
Your violation of any applicable laws or third-party rights.
Content you submit, post, or transmit through the app.
Your participation in any sports activities coordinated through the app.

18. Dispute Resolution

Informal Resolution: Before filing any legal claim, you agree to contact us at support@recsoccer.app and attempt to resolve the dispute informally for at least 30 days.
Arbitration: Any dispute that cannot be resolved informally shall be resolved by binding arbitration in accordance with the rules of the American Arbitration Association (AAA).
Class Action Waiver: You agree to resolve disputes with us on an individual basis only, and waive any right to participate in class actions or class arbitrations.
Small Claims Exception: Either party may bring claims in small claims court if the claims qualify.
Injunctive Relief: Notwithstanding the above, either party may seek injunctive relief in any court of competent jurisdiction to protect intellectual property rights.

19. Governing Law

These terms are governed by the laws of the State of Ohio, USA, without regard to conflict of law principles.
For disputes not subject to arbitration, you consent to the exclusive jurisdiction of the state and federal courts located in Ohio.
The United Nations Convention on Contracts for the International Sale of Goods does not apply to these terms.

20. Changes to Terms

We may update these terms from time to time to reflect changes in our services or legal requirements.
We will notify you of significant changes via email, in-app notification, or by posting a notice on our website.
Your continued use of the app after changes take effect constitutes acceptance of the new terms.
If you do not agree to the updated terms, you must stop using the app and may delete your account.
